By using FunnelCockpit, particularly the services and tools provided, you agree to the following terms of use. We expect careful and responsible conduct from both ourselves and our users.
Duty to provide information
All websites created by users must include a link to a valid legal notice pursuant to Section 5 TMG so that third parties can promptly obtain information about the respective provider. This applies both to pages operated through a subdomain on funnelcockpit.com and to pages operated through our WordPress plugin or a CNAME record using the user’s hosting solution. Users must obtain information about the required disclosures, as different rules apply in different countries.
Prohibited content
Although we do not want to restrict our users’ creativity, we do not permit pornographic, violent or other illegal content. Such content may therefore not be sold, promoted or otherwise published through, with or using our services. Similarly, file-sharing services, particularly copyrighted works, may not be published through, with or using our services. Since we cannot rule out copyright infringements despite careful checks, the user is liable in every case for claims by the original copyright holder or their legal representative.
Consequences of violating our terms of use
- We immediately suspend the user’s account
- Payments already made will not be refunded
- In the event of serious violations, we pursue claims for damages in court
Liability
Users are solely liable for the content they create on websites and any other content published through our services. Users also confirm to us that they have acquired or hold the rights to use any incorporated content. We cannot be held liable for copyright or trademark infringements in the absence of fault on our part. Users create content independently, and we cannot subject it to editorial or legal review.
Cancellation
Users may cancel their FunnelCockpit subscription at any time with effect from the end of the billing period. At the end of that period, they lose access to the internal membership area and all created content. To save page templates, we recommend the “Export” function available in our FunnelBuilder. Cancellation cannot be reversed. If a user wishes to use the services again, a new paid account must be created.
Availability and warranty
Normal access interruptions do not constitute a breach of Funnel Cockpit’s obligation to provide its services. Funnel Cockpit will promptly resolve faults in its technical systems within the available technical and operational capabilities. Necessary service interruptions for preventive or required maintenance will be announced as early as possible once they are known. Funnel Cockpit is not responsible for outages in which the online software is inaccessible or displayed incorrectly because of technical or other problems outside the provider’s control, such as force majeure or fault by third parties.
